บุตรนอกสมรสโดยบิดามารดาไม่ได้จดทะเบียนสมรสกัน และมิได้ฟ้องคดีขอให้บิดารับเด็กเป็นบุตรโดยชอบด้วยกฎหมาย จะฟ้องเรียกค่าอุปการะเลี้ยงดูและค่าการศึกษาจากบิดาได้หรือไม่?

-สามีภริยาอยู่กินกันโดยมิได้จดทะเบียนสมรส มีบุตรด้วยกัน ขณะอยู่กินกับสามีก็ได้ให้การรับรองบุตร เมื่อภริยาแยกกันอยุ่กับสามีและอุปการะเลี้ยงดูบุตรเพียงผุ้เดียว ภริยาจะฟ้องเรียกค่าอุปการะเลี้ยงดูบุตรไม่ได้เพราะว่าบุตรนั้นเป็นบุตรนอกสมรส ไม่ได้เป็นบุตรโดยชอบด้วยกฎหมายของบิดา แม้ว่าสามีจะเป็นบิดาตามความเป็นจริงของบุตรก็ตาม  ภริยาต้องฟ้องคดีขอให้สามีรับเด็กเป็นบุตรเสียก่อน (ฎีกา 7228/2537)

-บิดามารดามีหน้าที่ต้องอุปการะเลี้ยงดูบุตรและให้การศึกษาตามควรแก่บุตรในระหว่างที่เป็นผู้เยาว์ จนเมื่อบุตรบรรลุนิติภาวะแล้ว บิดามารดาจึงจะหมดหน้าที่ดังกล่าว ซึ่งบุตรที่จะได้รับสิทธิดังกล่าวนี้จะต้องเป็นบุตรโดยชอบด้วยกฎหมายแล้วเท่านั้น (ปพพ.มาตรา 1564วรรค1)

-หากแต่บุตรที่บรรลุนิติภาวะนั้นจะเป็นคนทุพพลภาพและหาเลี้ยงตนเองไม่ได้ บิดามารดายังต้องอุปการะเลี้ยงดูบุตรนั้นต่อไป (ปพพ.มาตราา 1564วรรค2)
